        <![CDATA[<p>At least one person was injured on May 10 when a car driver ignored a stop sign. Massachusetts authorities continue to investigate the <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">car accident</a>, and one arrest has been made in connection with the crash. A 36 year-old man is suspected of driving under the influence of alcohol at the time of the accident.</p>
<p>The driver of a full-sized sedan failed to stop at a stop sign, causing it to crash into a four-door Audi at an intersection. The accident was reported to have occurred at about 10:25 p.m. The impact sent the Audi into a large concrete post used to keep traffic away from a grassy area in the back yard area of an apartment complex. The first car continued across the street and over a sidewalk, finally stopping in a park. Reports indicate that there were several near misses from hitting trees along the way.</p>]]>
        <![CDATA[<p>One person was reportedly injured and transported by ambulance from the scene of the accident. Details concerning the nature and extent of the injuries were not immediately unknown. Both vehicles suffered front-end damage and had to be taken from the scene by tow truck, causing traffic to be blocked at the intersection for a short period of time. Police reportedly confiscated a six-pack of an unidentified alcoholic beverage from one of the crashed vehicles, placing it into the truck compartment of the police car. A more detailed investigation by Massachusetts authorities will most likely follow this car accident and more facts may be disclosed in the upcoming criminal proceedings against the driver who seemingly caused the collision.</p>

Unfortunately, when an individual uses poor judgment and gets behind the wheel after drinking, a <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">car accident</a> is often times the result, leaving innocent victims with injuries.</p>
<p>An Everett man has been charged with driving under the influence of alcohol in a two-car accident that injured a woman and her dog, shutting down Interstate 93 for more than an hour on Sunday, April 20.</p>]]>
        <![CDATA[<p>According to Massachusetts authorities, the accused man was headed southbound on the interstate prior to the accident. Police are not yet sure what caused one vehicle to crash into the guardrail and send the second one into the median. The driver of the second car was sent to Lahey Clinic in Burlington with what were initially thought to be minor injuries, though no further word on her medical condition was reported. She had a dog as a passenger in her vehicle, and it was sent to Woburn Animal Hospital treatment.</p>
<p>The man charged with DWI was not injured in the car accident, though both vehicles had to be towed from the wreck. Often, in the immediate aftermath of a collision, injuries thought to be minor turn out to be more serious in the days and weeks following a crash. While it remains to be seen how the injured woman will progress, she may wish to consider filing a personal injury claim for reimbursement of her expenses and other damages caused by the collision. Massachusetts law provides for the right of victims injured by the negligence of others to seek redress in its courts for medical expenses, lost income and other damages such as pain and suffering caused by the injuries received.<a></a></p>

        <![CDATA[<p>Several people were injured in Massachusetts when a tractor-trailer collided with a car that was waiting in traffic for children to board a school bus on the morning of April 23. The crash occurred on Route 28 in Middleboro. Massachusetts State police reported that six ambulances were called to the scene of the <a href="http://www.gallant-ervin.com/Practice-Areas/Personal-Injury.shtml" target="_blank">truck accident</a> to assist with the multiple injuries caused by the collision. At least two people sustained serious injuries.</p>
<p>The school bus was not damaged, and thankfully no students on the bus were injured. State police closed Route 28 in both directions during the accident investigation. Heavy rain was reported in the area around the time of the accident. However, it has not been confirmed if weather was a factor, and the accident is still under investigation.</p>]]>
        <![CDATA[<p>Unfortunately, multiple-car accidents often involve multiple injuries. Those injured may have the right to file a legal claim against any party whose negligence caused or was deemed a contributing factor in an accident. If negligence on the part of any individual caused or contributed to the collision, a legal basis to pursue civil claims for personal injury may exist.</p>
<p>There was no preliminary indication if authorities intended to issue any citations in connection with the truck accident. Nevertheless, those involved will likely benefit from reviewing all relevant evidence, including the official accident report.         <![CDATA[<p>A busy weekday morning ended in a car accident abruptly for three Massachusetts drivers on April 18. Police say that a man and a woman were hospitalized after the multi-car collision. The <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">car accident</a> happened just after 7:50 a.m. at the intersection of Boston Road and Brainard Road in Wilbraham.</p>
<p>Police say a Wilbraham man in a Toyota Rav4 was heading westbound on Boston Road with the intention of making a left turn onto Brainard. While making the turn, he collided with a Jeep Grand Cherokee that was entering the intersection in the eastbound lane. The impact of the car accident caused the Jeep to overturn. The Rav4 began a 180-degree spin and thereafter struck a van stopped in the roadway.</p>]]>
        <![CDATA[<p>The Jeep driver was injured and taken to the Baystate Medical Center. She was listed in good condition. Additionally, the Rav4 driver was taken to Wing Memorial Hospital for treatment. He was later released. The driver of the van was said to have escaped injury.</p>
<p>Authorities indicated they were continuing to investigate this car accident. Though the injuries to the drivers appear to be non-life threatening, they may still result in substantial medical bills, lost wages and long recovery times. Additionally, there may be other damages suffered, including the potential for pain and suffering occasioned by the injuries received.</p>
<p>When a person finds that they are the victim of a car accident, it is typically in their best interests to gather all available evidence of the collision and its aftermath, including documentation for medical treatments and expenses incurred.         <![CDATA[<p>Four Massachusetts teenagers were hospitalized with injuries after a car in which they were riding collided with a school bus on March 30 in Kingston. The bus did not have any passengers at the time of the <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">car accident</a>, having just discharged its last passenger. The accident happened as the teens were driving to school for the day.</p>
<p>The car accident occurred on the morning of the junior prom for the high school, at about 7:15 a.m. Three girls and a boy were in a car when it was said to have crossed double yellow lines on the roadway before striking the school bus head-on. The car accident happened near the school grounds of Silver Lake Regional High School.</p>]]>
        <![CDATA[<p>All of the students were injured in the crash. Two had to be evacuated by MedFlight helicopters and all four were still in Boston-area hospitals that night. According to a news report, the students were in serious condition.</p>
<p>Kingston and Massachusetts State Police were continuing to investigate the car accident. As the investigation moves forward, a determination will likely be made as to which party or parties were at fault in causing or contributing to the collision. Those students seriously injured may be entitled to pursue personal injury claims to recover monetary damages incurred as a result of any negligence of others.</p>
<p>While it is too early to conclude precisely what happened in this car accident, authorities will undoubtedly focus on the preliminary indication that the vehicle crossed a double yellow line. Once the official accident investigation report is issued, those involved may wish to review it in conjunction with other available evidence in order to assess their rights and responsibilities under Massachusetts law. In that manner, each party can decide whether or not they wish to pursue a personal injury claim.</p>

        <![CDATA[<p>An avid bicyclist from Attleboro recently died after crashing his bike in Rohoboth. The accident has brought to light a possible product defect which could potentially lead to a future <a href="http://www.gallant-ervin.com/Practice-Areas/Personal-Injury.shtml" target="_blank">product liability</a> case in the death of the 58-year-old man.</p>
<p>According to reports, the father of three was found by a police officer who was on his way to work just before 6 p.m. The man's wife told police he was training for a 150-mile charity bike ride, in which he had participated for the past 14 years.</p>]]>
        <![CDATA[<p>Police are citing a mechanical issue with the bicycle's fork as the possible cause of the crash, although the fatal crash is still under investigation. Police say it doesn't appear any other vehicles were involved in the incident. Authorities say the fork on the bike detached from the bicycle.</p>
<p>When the officer found the man, he was wearing a helmet but had suffered head trauma. The biker was said to be moving at about 25 mph, which is reportedly a normal speed for an experienced bicyclist in training.</p>
<p>When a news organization tried to reach the bicycle company, called Cervelo, via their website, they noticed that the fork unit on the Soloist model bikes was the subject of a recall. That is the same model the man was riding at the time of the accident.</p>
<p>Although the company only manufactures the frame, a separate company out of Tennessee actually designs and makes the fork component. According to a statement from Cervelo, "Under certain conditions, the fork steerer can crack and eventually break during normal use, which may cause the rider to lose control, fall and suffer potentially serious injuries."</p>
<p>Defective products cause thousands of injuries in the United States each year. Manufacturers have a duty to make products that are safe. State and federal laws provide that anyone injured through the use of a defective product can seek compensation for their injuries. In this case, the family of the man may choose to seek compensation in order to cover funeral costs, lost wages, and for pain and suffering.</p>

        <![CDATA[<p>A Middlesex County accident on Interstate 93 has left one woman dead, a passenger seriously injured and a third individual facing drunk driving charges for crashing into the police cruiser and tow truck that responded to the scene of the first collision. Details concerning that accident are sketchy, although it was said to have occurred on the morning of Sunday, March 31.</p>
<p>The first <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">car accident</a> happened when a woman's vehicle struck a box truck that was parked in the breakdown lane of the interstate highway. In addition to the deceased woman, police indicated a Massachusetts man from Medford, who was riding in the woman's car, was seriously injured. Information was not immediately available as to his further condition or where he was hospitalized.</p>]]>
        <![CDATA[<p>Following that accident, police say a 29-year-old Lawrence resident struck both the police vehicle and tow truck. He was injured in the crash and has been hospitalized under police guard, though the extent of his injuries was not reported. It was also not known if anyone else was injured as a result of the second car accident. Authorities plan to arrest the Lawrence man for drunk driving allegations once his medical condition permits.</p>
<p>Further details of both accidents will presumably have to await the official report of the investigation. The seriously injured passenger, as well as the surviving family of the deceased woman, may look to the report to assess what rights and responsibilities they may have under Massachusetts law. Though the second car accident was attributed by police to drunk driving, the accused person may also have interest in the report to decide whether or not he may have a claim under civil law for the injuries he sustained, particularly if evidence exists that the negligence of another party caused or contributed to that collision.</p>

        <![CDATA[<p>A three-car accident occurred on Route 138 in the Massachusetts town of Easton on March 19. That car struck another vehicle almost head-on, according to preliminary reports. A third vehicle became enmeshed in the car accident when it struck the car in front of it.</p>
<p>Investigations continue to determine the official cause of the car accident. All of the involved drivers were taken to local hospitals with unknown injuries. One of the drivers lost consciousness and reported abdominal pain and was subsequently airlifted to a hospital in Boston.</p>]]>

<p>Police say that a driver was likely under the influence of alcohol when he drove the wrong way on Route 93 in Middlesex County. The car accident occurred on March 11 shortly before 8:30 p.m. and caused injury to four people. The collision caused the highway to be closed for approximately 30 minutes to clear up the accident scene. The injured were transported to Winchester Hospital where they were thought to have non-life-threatening injuries. Three of the four cars involved in the car accident had to be removed from the scene by tow truck.</p>]]>
        <![CDATA[<p>Police say that the driver has been charged with multiple offenses including leaving the scene of an accident and causing personal injury. He was taken into custody and released after posting bail. The 63-year-old man is expected to appear in court on March 20.</p>
<p>The injuries suffered by the car accident victims, though not life-threatening may still result in economic loss<a></a>. Medical treatments at the scene, ongoing recovery, lost wages and damages are just a few of the economic hardships that can be suffered after a Massachusetts car accident.         <![CDATA[<p>The reported details of a fatal collision in the eastbound lanes of I-195 in Swansea, Massachusetts, which is about 60 miles south of Boston, underscore the difficulty confronting the state police in determining precisely what occurred.</p>
<p>The accident reconstruction unit is reportedly investigating the death of a woman struck by a Volkswagen Passat just after midnight on March 10. Also, the victim's twin sister was seriously injured after being struck separately by a Honda Civic. Central to the investigation of each <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">car accident</a> is how it happened that one sister was killed in the left-hand passing lane and the twin was struck in the center lane, while their apparently disabled vehicle was stopped in the breakdown lane.</p>]]>
        <![CDATA[<p>The twins' Chevrolet broke down on I-195 eastbound, though it was not immediately clear who was driving. The twins were said to be outside of the vehicle, which they managed to get into the breakdown lane, though it is not yet clear on which side of the highway their vehicle had stopped. Reports indicated the women were outside of the vehicle working on it prior to the car accident, and police were on their way to assist at the time of the tragic incidents. It is yet to be determined if the twins, who were said to be fond of dancing and often enjoyed trips to Providence on weekends, were attempting to cross the interstate at the time the collisions occurred.</p>
<p>As the police continue their investigation, the families of the twins are left to mourn the death of one and pray for the full recovery of the other. The one that survived was reported to be in Rhode Island Hospital with serious injuries. The twins, along with the drivers of each vehicle that struck them, reside in Fall River. While it is too early to draw any conclusions from either car accident, the family of the victims, as well as the car drivers who hit them, will understandably be interested in the results of the formal investigation by Massachusetts police in order to determine their respective rights and responsibilities in relation to the collisions.</p>

A collision is sometimes the result of a moment's distraction or other potentially negligent action. Police down in Bristol County are investigating two crashes which happened in Rehoboth on Feb. 28.</p>
<p>The first car accident occurred shortly after 10 a.m. on Bay State Road. One individual from both of the vehicles involved was rescued and the two injured people were transported to the hospital for treatment for injuries sustained in the head-on collision. No further word on their condition was available, and police closed the roadway for about two hours to investigate the collision and arrange for cleanup of debris.</p>]]>
        <![CDATA[<p>The second incident happened on Winthrop Street where it intersects with Williams Street, shortly before 3:30 p.m. The four-car collision substantially damaged two of the vehicles while the other two sustained moderate damage. As with the earlier car accident, police closed the roadway to traffic to investigate the incident and arrange for work crews to clear the streets. Three individuals were said to be injured and were transported to Rhode Island Hospital, though there was no information concerning the extent of any injuries or the condition of the people hurt.</p>
<p>While police will presumably issue formal accident reports, those involved in the collisions will likely want to know the results. Anyone suffering serious injuries in the greater Boston area or any part of the state may have a claim to recover monetary damages if it is found that the injuries were the result of negligence on the part of another party. While it is too early to fully understand what occurred in these incidents, those involved would do well to investigate their options as they assess their legal right to pursue financial remuneration for expenses incurred and lost income, as well as for any pain and suffering related to their injuries.</p>

        <![CDATA[<p>It is often said in the greater Boston area that a car accident can occur in the amount of time it takes someone to cross a street. Out in Worcester on Feb. 24 that turned out to literally be the case. A 24-year-old woman was crossing Park Avenue near Parker Street with another woman when they were both struck by a car shortly before 11 p.m. The <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">auto accident</a> turned into a hit-and-run incident when the driver turned off his headlights and drove away. The second woman appeared to escape serious injury and assisted at the scene, but the first was transported to the University of Massachusetts Medical Center - University Campus with multiple injuries.</p>
<p>Police say they are searching for a Toyota, Nissan or Honda with four doors that may have sustained damage from the auto accident to its front and possibly to the windshield. A witness said the pair was in a crosswalk moving from east to west when the force of the collision forced the more seriously injured woman to land on the hood and windshield of the car before falling to the ground. She suffered injuries to her head as well as he neck, shoulder and arms. Further word on her medical condition was not immediately disclosed. Police closed Park Avenue to photograph the scene of the car crash from numerous angles, and the investigation is ongoing.</p>]]>
        <![CDATA[<p>While the focus of the victim's family and friends is understandably on her recovery from the hit-and-run auto accident, they will likely also want the driver apprehended. In addition to potential criminal charges, the victim may elect to pursue a claim for personal injuries against any parties deemed negligent in the collision. In the greater Boston area and throughout Massachusetts, these types of claims are authorized by law to collect monetary damages from those that negligently cause injury. The damages may include medical expenses, lost wages and other expenses as well as pain and suffering occasioned by the injuries. The victim and her family will benefit from reviewing any accident report together with further information from the authorities and other evidence as they decide whether a claim is appropriate.</p>

<p>Police closed traffic for approximately four hours as it investigated the car accident, handled by the department's accident reconstruction unit. While the family and loved ones of the victim are likely preoccupied with his medical condition and potential recovery, they will also want to know exactly what occurred. In the immediate aftermath of a serious car accident it is not always clear what transpired because the first priority is tending to any injured parties and coordinating efforts to ensure that the best possible medical care is provided as quickly as possible.</p>]]>
        <![CDATA[<p>If evidence is developed that shows the Honda driver or another party acted negligently in a manner that caused or contributed to the victim's injuries, a claim for personal injuries may be appropriate under Massachusetts law. Such a claim would seek to recover monetary damages for the injuries suffered as well as any consequent pain and suffering. While the findings of the police investigation may be helpful in established what occurred in this Essex County car accident, a civil claim brought by the victim is independent of and in addition to any police action taken.         <![CDATA[<p>As residents in Massachusetts and across the United States become more dependent on personal electronics, the risk of distracted driving is bringing attention to officials nationally. According to a news report, more than 3,000 people died in <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">car accidents</a> that were related to distracted driving in 2010. The U.S. Transportation Department says drivers are 23 times more likely to be involved in a crash if they are texting while driving. These statistics are showing up on roadways and have prompted family members of victims to try to raise awareness.</p>
<p>Websites such as distraction.gov have popped up in order to shine a light on the growing issue. Family members are using nonprofits such as FocusDriven, which concentrates on the dangers of texting and driving, to voice their concerns.</p>]]>
        <![CDATA[<p>Officials say although cellphones have become a sort of symbol for distracted driving, the issue did not start with personal technology. Distracted driving can come from scolding children in the back seat, tuning your radio or even talking to a passenger while on the road. A recent case of distracted driving had a very tragic end and did not stem from cellphone use. A man, along with his wife and 1-year-old child, was driving his sport utility vehicle and simultaneously searching for a DVD in his car. The distraction caused him to swerve into oncoming traffic, killing his wife. Two people -- a husband and wife -- were also killed in the other vehicle. Two of the three children in that car were paralyzed in the crash.</p>
<p>When people choose not to concentrate on the road while driving, they put all of the people around them at risk. If their negligent behavior leads to personal injury of another, they may be held liable.</p>

        <![CDATA[<p>Drivers in Massachusetts have to contend with some difficult road conditions. Many cities and towns have old colonial roads that twist, turn, narrow and intersect at odd places. Massachusetts roads are also known for having their fair share of potholes. Add heavy winter snow and ice to the mix, and you can safely say that driving in this state is no easy task. But one thing drivers should never have to worry about is a <a href="http://www.gallant-ervin.com/Practice-Areas/Car-Accidents.shtml" target="_blank">drunk driver</a>.</p>
<p>Unfortunately, drunk drivers are as much of the landscape as potholes. This week a Taunton woman received a prison sentence of six to eight years for her role in a fatal drunk driving crash. The accident occurred in July 2009 on Route 140 in Taunton. According to prosecutors, her vehicle's black box indicated that she was speeding at an astounding 113 miles per hour. She quickly approached another car from behind and, failing to slow down or avoid the other car, slammed into it.</p>]]>
        <![CDATA[<p>The violence of the impact sent the other vehicle careening off the road and killed its back seat passenger, who was a 48-year-old married father with a young daughter. The drunk driver survived the crash and left the scene of the accident on foot. She was apparently uninjured and walked a mile before being apprehended by police. She was charged and convicted of leaving the scene of a deadly accident and manslaughter while driving drunk.</p>
<p>Regrettably, this accident could have been prevented. The woman has a long history of driving violations, and many others like her continue to make the life-altering choice to drink and get behind the wheel of a car.</p>
